Thank you for choosing Perfectly Morocco Tour for your  travel experience. Perfectly Morocco Tour (hereinafter referred to as “the Company,” “we,” or “us”) is a fully registered and officially licensed boutique tour operator operating under the tourism laws of the Kingdom of Morocco.

1. The Contract & Acceptance of Terms

By submitting a deposit, completing a booking, or utilizing any services provided by Perfectly Morocco Tour, you (the “Client,” “Passenger,” or “Guest”) enter into a legally binding contractual agreement with the Company.

You explicitly accept and agree to be bound by these Terms and Conditions on your own behalf and on behalf of all other persons included in your booking. If you are making a booking on behalf of a group or family, you warrant that you have the legal authority to accept these terms on behalf of all participants in your party.

The contract between the Company and the Client becomes effective only upon the issuance of our official Booking Confirmation and the successful receipt of the required deposit.

2. Booking Procedures & Payment Schedule

Your booking is confirmed upon receipt of a non-refundable deposit of 25% of the total tour cost. Upon receipt of the deposit, we will issue your formal Booking Confirmation and begin securing your accommodations, transportation, and specialized local guides. 2.1 Deposit and Confirmation

Your booking is confirmed upon receipt of a non-refundable deposit of 25% of the total tour cost. Upon receipt of the deposit, we will issue your formal Booking Confirmation and begin securing your accommodations, transportation, and specialized local guides. 

2.2 Final Balance Payment

The remaining balance of 75% of the total tour cost must be paid in full no later than 15 days prior to your scheduled departure date.

  • If a booking is made within 15 days of departure, the full 100% payment is required immediately upon booking.
  • Failure to pay the remaining balance by the due date may result in the automatic cancellation of your booking, forfeiture of your deposit, and the release of all reserved properties and services.

2.3 Accepted Payment Methods & Security

To provide maximum convenience and institutional-grade security for our high-net-worth clients, the Company accepts the following payment methods:

  • Secure Electronic Wire Transfers / Bank Drafts (SWIFT/IBAN)
  • Major Credit Cards: Visa, MasterCard, American Express, and Discover.
  • Verified PayPal Accounts

Payment Security Notice 

All digital and credit card payments are processed via secure, third-party, PCI-DSS compliant payment gateways. Perfectly Morocco Tour does not store, view, or retain your credit card or financial account numbers on our servers.

3. Tiered Cancellation & Refund Policy

Perfectly Morocco Tour designs bespoke, high-end itineraries that require immediate, non-refundable financial commitments to elite local suppliers, boutique riads, desert camps, and private aviation partners. Because these independent properties maintain strict booking policies, the Company must apply the following tiered cancellation schedule.

3.1 Cancellation Requests

All requests for cancellation must be submitted to the Company in writing via email by the primary Client who made the booking. The date on which the Company receives the written notice will serve as the sole official date for calculating cancellation fees.

3.2 Cancellation Fee Schedule

Cancellation fees are calculated as a percentage of the total tour cost, based on how many days prior to the scheduled departure date the written notice is received:

  • 15 days or more prior to departure. The 25 % deposit is forfeited as a non-refundable administrative and supplier retention fee. Any additional balance payments made above the 25 % deposit will be fully refunded to the Client.
  • 14 days or less prior to departure (including no-shows). 100% of the total tour cost is non-refundable. No cash refunds will be issued.

3.3 Exceptional Circumstances and Credit Vouchers 

In exceptional circumstances, if a Client must cancel their trip within the 30-day window due to unexpected personal or medical emergencies, Perfectly Morocco Tour may, at its sole discretion and subject to supplier availability, offer a Future Travel Credit.

  • This credit will exclude any non-recoverable costs already swallowed by hotels or local logistics.
  • The remaining balance may be applied toward a rescheduled itinerary within 12 months of the original departure date.

3.4 Unused Services and Early Departures

No refunds, adjustments, or credits will be provided for any unused portions of the tour itinerary after departure. This includes, but is not limited to, missed sightseeing, unutilized private transport, skipped meals, voluntary early departures, or hotel nights left vacant by the Client for any reason whatsoever.

4. Changes to Your Booking & Itinerary Modifications

4.1 Modifications Requested by the Client

Perfectly Morocco Tour will make every reasonable effort to accommodate amendments, date changes, or itinerary modifications requested by the Client.

  • All requests for changes must be submitted in writing by the primary Client.
  • While the Company does not charge an administrative fee for changes made more than 30 days prior to departure, any additional costs levied by third-party suppliers (such as riads, domestic airlines, or private venues) will be passed directly to the Client.
  • Major modifications requested within 15 days of departure may not be logistically feasible due to the exclusive nature of bookings. If a requested change cannot be accommodated and the Client chooses not to proceed with the original itinerary, the action will be treated as a cancellation under Section 3.

4.2 Minor Flexibility by the Company

Operating tours in dynamic environments requires operational flexibility. The Company reserves the right to make minor modifications to your itinerary (e.g., altering the sequence of cities visited, substituting a boutique hotel for another property of equal or higher standard) due to local conditions, weather, or sudden availability changes. The Client will be notified of any significant changes immediately.

5. Force Majeure & Unforeseen Circumstances

5.1 Definition of Force Majeure

Neither the Company nor the Client shall be held liable for failure or delay in performing their obligations under this contract if such failure arises from a Force Majeure event. This includes, but is not limited to: acts of God, natural disasters (earthquakes, severe weather), war or threat of war, terrorism, civil unrest, government restrictions, pandemics, strikes, or nuclear disasters.

5.2 Company Cancellations Due to Force Majeure

In the highly unlikely event that Perfectly Morocco Tour must cancel an entire tour prior to departure due to a Force Majeure event rendering the trip unsafe or logistically impossible:

  • The Company will provide a full refund of all monies paid by the Client, including the 30% deposit.
  • Alternatively, the Client may opt for a Future Travel Credit to reschedule the experience at a later date.

5.3 Limitation of Consequential Damages

The Company’s financial liability is strictly limited to the total amount paid by the Client to Perfectly Morocco Tour. The Company is not responsible or liable for any incidental or consequential expenses incurred by the Client as a result of a canceled tour, including but not limited to: non-refundable international airline tickets, visa fees, vaccinations, or loss of earnings.

6. Special Requests & Accessibility

The Company prides itself on delivering highly personalized, bespoke travel experiences. Any special requirements—including but not limited to dietary restrictions, severe allergies, medical conditions, mobility assistance, or specific bed configurations—must be communicated to the Company in writing prior to booking.

  • While the Company will make every reasonable effort to ensure our partners (hotels, private chefs, transport suppliers) accommodate these preferences, some high-end historical properties (such as ancient riads in the Medina) may have structural limitations regarding wheelchair accessibility.
  • No financial compensation or refunds will be issued if a third-party supplier is unable to fulfill a non-essential special request.

7. Mandatory Travel Insurance & Client Risk

7.1 Requirement for Comprehensive Coverage

Because Perfectly Morocco Tour operates high-ticket, itineraries, the purchase of comprehensive travel insurance is a mandatory condition of booking. Clients are strictly required to secure individual insurance coverage that includes, at a minimum:

  • Trip Cancellation and Interruption (we strongly recommend a “Cancel For Any Reason” / CFAR policy).
  • Emergency Medical Expenses & Air Evacuation Coverage.
  • Baggage Loss and Travel Delays.

7.2 Proof of Insurance

The Company reserves the right to request proof of a valid travel insurance policy prior to the start of the tour. Perfectly Morocco Tour assumes zero financial liability for costs associated with medical emergencies, repatriation, or last-minute trip cancellations that could have been fully covered by standard travel insurance.

8. Limitation of Liability & Third-Party Suppliers

8.1 Independent Contractor Status

Perfectly Morocco Tour acts exclusively as an intermediary agent. We curate itineraries by contracting independent, licensed, and trusted third-party providers, including hotels, local riads, transport companies, desert camps, and independent guides. Each of these suppliers operates under its own legal terms and the local laws of the Kingdom of Morocco.

8.2 Scope of Company Liability

The Company takes meticulous care in selecting only elite-tier suppliers. However, since the Company does not exercise direct physical control over the day-to-day operations of these independent businesses, Perfectly Morocco Tour shall not be held liable or responsible for any injury, illness, property damage, financial loss, delay, or death resulting from the acts, omissions, bankruptcy, or negligence of any third-party supplier.

8.3 Maximum Financial Cap

In the event that a court of competent jurisdiction finds the Company liable for any failure to deliver the services described in the Booking Confirmation, the Company’s maximum financial liability to the Client shall be strictly capped at the total amount paid by the Client to Perfectly Morocco Tour for that specific, failed portion of the itinerary.

9. Travel Documentation & Visas

The Client is solely responsible for ensuring possession of valid required travel documents prior to departure. In accordance with international regulations, your passport must be valid for at least 6 months beyond your planned date of departure from Morocco. Perfectly Morocco Tour assumes no responsibility for trip interruptions, delays, or deportations resulting from improper, damaged, or missing passports, visas, or health documentations.

10. Privacy, Data Protection & Confidentiality

Perfectly Morocco Tour is fully committed to safeguarding the privacy and personal data of our high-net-worth clientele.

  • All personal information collected during the booking process is secured using industry-standard digital encryption.
  • Your data will be utilized exclusively to secure reservations with our hospitality, transport, and guiding partners.
  • The Company strictly adheres to international privacy principles and will never sell, trade, or expose your confidential information to unverified third parties.

11. Guest Relations, Complaints & Governing Law

11.1 On-Site Resolution

In the highly unlikely event that a specific portion of your journey does not meet your expectations or the advertised standard, you must immediately contact your dedicated private driver or your 24/7 concierge support manager. Our primary operational goal is to rectify any issue in real-time, on the spot, ensuring your peace of mind and the seamless continuity of your vacation.

11.2 Post-Tour Feedback

If an issue remains unresolved on-site, the Client may submit a formal review in writing within 30 days of the tour’s completion. We approach every guest’s feedback with the utmost seriousness, mutual respect, and a dedication to absolute excellence.

11.3 Governing Law

These Terms and Conditions, and the overarching contractual agreement between the parties, shall be governed by, interpreted, and enforced exclusively in accordance with the laws of the Kingdom of Morocco. Any legal disputes arising directly from this contract shall be settled within the competent jurisdiction of the courts of Morocco.
